Real estate and infrastructure management 

The firm assists developers, project owners, lessees, etc. with the structuring of all types of transactions, including complex transactions (CPI, BEFA, sales, exchanges, etc.). Particular focus is placed on negotiation and drafting of contracts and works contracts.

Town Planning Litigation

Town planning litigation in administrative courts, particularly in relation to planning permission, is a specific and regulated form of litigation. This is due to the need to reconcile the right to take legal action with the objectives of development, town planning and construction.

We represent both plaintiffs and defendants.

More generally, we handle administrative litigation before all administrative tribunals, in both appeals for exceeding powers (REP) and appeals for compensation (full litigation). 

The firm also handles civil and criminal litigation relating to town planning.

Directives on use, destinations, ERP, ICPE, etc.

Some projects require several regulations to be taken into account, which can be cumulative. These include those deriving from the Town Planning Code/Code de l’Urbanisme (authorisation of works, destinations, etc.), the Construction and Housing Code/ Code de la Construction et de l’Habitation (use, establishments receiving the public (ERP), etc.), the Environment Code/ Code de l’Environnement (installations classified for environmental protection, etc.) and the Code du Patrimoine (ABF – historic monuments, preventive archaeology, etc.).

We act on the basis of these specific regulations and related legislation, which must be taken into account when structuring the transaction, and coordinated where necessary.

We are, of course, also involved in monitoring and enforcing these regulations, particularly with regard to industrial and environmental risks.

Planning law

The creation and implementation of real estate projects requires the prior obtaining and validation of work permits. 

We intervene at the stage of examining applications for planning permission, by analysing their compliance with national planning regulations (e.g. rules on land development, ZAN, etc.) and local regulations (e.g. SCoT, PLU, PLUi, PLUb, etc.).

We are also involved in the pre-investigation and investigation phases, as well as in the clearance of withdrawal rights and third-party appeals.
